Royal M. Bassett and E. F. Bishop v. Utah Western Railway
- On July 1, 1874, the railroad issued 720 bonds in the amount of $1,000 each, payable in 20 years at 7% per annum interest
- The bondholders held all of the railroads 720 bonds
- The railroad first defaulted on January 1, 1878 on six months interest due at that time
- Defaulted continuously ever since
- Plaintiffs were trustees of the railroad company, acting for the bondholder's committee
- Trustees took possession of the railroad on April 16, 1878
- Railroad was ordered to be sold on August 2, 1880
- Original auction date was September 13, 1880
- Postponed to October 13, 1880
- Postponed again to November 3, 1880
- Paid $22,957.68 to M. Shaughnessy, U. S. Marshall, being the net profits and income of the railroad up to November 3, 1880, the time of the sale of the railroad property.
- The U. S. Marshall paid the money to the court clerk
- Theodore S. Bassett bought the railroad on November 3, 1880.
- Sold to Theofore S. Bassett for $36,000 by his lawyers, William & Young

- Purchase was completed with the understanding that the remaining shares would be turned over to him upon his arranging for credit to complete the railroad to Alta
- Purchase price of the 1,000 shares was $25,000 floating debt
- Railroad was completed to Alta in September 1875
